Your privacy is important to us. Maintaining your trust and confidence is one of our highest priorities. We ensure secure transactions and strive to take reasonable care in the protection of information we receive during the course of us rendering services.
As used in this Privacy Policy, terms such as "we" or "our" or "us" or "Company" refer to Jlmush Med Triangle Limited
The purpose of this Privacy Policy ("Privacy Policy" / "Policy"), as amended from time to time, is to give you an understanding on how we intend to collect, store, transfer, disclose, process and use the information you provide to us through our website or mobile application (collectively known as "Platform").
This Privacy Policy may be subject to further changes including as may be warranted by change in law. Upon updating the Policy, we may revise the "Updated" date at the bottom of this Policy. We therefore request you to go through our Privacy Policy frequently to be updated with changes incorporated from time to time. Your continued engagement with us will imply your acceptance of such updates to this Policy.
If you do not agree to the terms of this Privacy Policy, please do not (i) access or use our Platform, (ii) avail of services from us, and do not disclose your information to us.
By providing us your and/or your family members and/or your dependents information, you hereby (i) consent to the collection, storage, disclosure, processing and transfer of such information for the purposes as disclosed in this Policy and (ii) represent that you have taken the necessary consents from such persons to provide us with such information. You are providing the information out of your free will. You have the option not to provide the data or Personal Information / Sensitive Personal Data or Information (as defined below) sought to be collected if you do not agree with this Policy.
1. Applicability
The terms of this Privacy Policy are applicable to all individuals and entities that visit, access and / or avail of our services via the Platform from whom we collect information, including insurers, healthcare providers, corporate clients and employees of corporate clients.
2. Collection of Information and Usage
We may collect certain Personal Information including Sensitive Personal Data or Information (as defined below) from you and/or your family members and/or your dependents while using our Platform or directly from the concerned insurer and / or your employer, if applicable.
Personal Information means any information that relates to or identifies you and/or your family members and/or your dependents and may include name, identity card number, date of birth, employee code, email address, residential address, mobile number, alternate telephone number, etc.
Further, you would be required to give us certain Sensitive Personal Data or Information about you and/or your family members and/or your dependents. Sensitive Personal Data or Information shall mean such Personal Information which consists of information relating to
- Financial information such as bank account or any other payment instrument details;
- Physical, physiological and mental health condition;
- Medical records and history; and
- Any detail relating to the above

We inform you that our Platform may collect certain Personal Information and/or Sensitive Personal Data or Information about you and/or your family members and/or your dependents such as medical and health records including but not limited to your prescription, test reports, past medical history, etc.
We understand that the Personal Information and/or Sensitive Personal Data or Information is extremely private to you and/or your family members and/or your dependents and assure you that it will be used only for providing required healthcare services as mutually agreed to be rendered by us, and as stated under this Policy.
While using our Platform and for availing of any of our services, you would be required to give us your and/or your family members and/or your dependents Personal Information and/or Sensitive Personal Data or Information. This could be done post login on our Platform using the credentials given by us, which will be shared with you by email, which is unique to you and you will be required to change the password at the time of first login.
When you visit our Platform, we may use GPS technology (or other similar technology) to determine your current location in order to determine the city or area you are located within for helping you in selection of right provider for the services you wish to avail. While using our Platform, you may also be required to give us access to few files available on your device. In case you do not want us to use your location for the purposes set forth above, you should turn off the location services. We may use your photo gallery or camera only to facilitate the uploading of documents or files in certain flow but we will not access information without your explicit consent. You have the option not to provide us with consent or to subsequently revoke consent, for our use of your device's camera / file and folders.
On receipt of express consent from the user, we collect certain information limited to user's name, email id and phone number provided by the user while installing and using the JLMUSH mobile app, we also collect certain non identifiable aggregated health-related information of the user from Apple Health Kit to create user profile which enable the user to automatically track their step count, water consumption, weight, calorie count and blood pressure. We do not store any payment details including but not limited to net banking, Credit card or Debit card details.
4. Access
You may be given the privilege to upload and store your and/or your family members and/or your dependents medical and health records on our Platform to which only you shall have access to by using your unique login credentials. This will help you have access to all your and/or your family members and/or your dependents medical and health records. We would like to reiterate that barring you, no one shall have access to these records except to the parties as mentioned in this Privacy Policy and such information shall be transmitted by us in encrypted form to avoid being hacked and decoded.
If you need to access your Sensitive Personal Data or Information, update or correct such information for any reason, you may do so by logging into the Platform and / or writing to us at grievance@JLMUSH.IN, and your Sensitive Personal Data or Information will accordingly be updated / corrected.
In the event you wish to know the names and addresses of the third parties your Personal Information has been disclosed to, you may request us for such information by writing to us at grievance@JLMUSH.IN. We will make all reasonable efforts to revert to you within a reasonable period of time, with the information that you require.
5. Purpose for which Personal Information and/or Sensitive Personal Data or Information is collected and processed
We would like to state that we collect Personal Information and/or Sensitive Personal Data or Information that is absolutely necessary and relevant for us to make your experience hassle-free, convenient, smooth and most importantly, safe. This will also help us in providing you with customized services, assist you with all your queries, resolve the issues faced by you, to follow up with you in order to ensure a long, sustained relationship and most importantly to safeguard you from any kind of fraudulent and unlawful usage.
Personal Information and/or Sensitive Personal Data or Information may be collected by us directly from you and/or your family members and/or your dependents for the purpose of providing healthcare services including inpatient & outpatient services, administration of health screening and wellness benefits.
6. Cookies
We use data collection methods / mechanisms such as "Cookies" on certain pages of the Platform to help analyse our web page flow and promote trust and safety. "Cookies" are small files placed on your hard drive that assist us in providing our services. We offer certain features that are only available through the use of "Cookies".
We also use "Cookies" to allow you to enter your password less frequently during a session. Most "Cookies" are "Session Cookies", meaning that they are automatically deleted from your hard drive at the end of a session.
You are free to decline our "Cookies" if your browser permits you to do so although we recommend strongly that you allow them to ensure you have access to all of our services.
7. Data Storage
All your Personal Information and/or Sensitive Personal Data or Information or medical records is hosted and/or processed by us at the Company's data centers located at our office situated at Bangalore, India or at such location(s) in India as the Company may so desire to store.
Your and/or your family members and/or your dependents' Personal Information and/or Sensitive Personal Data or Information or medical records is retained by us only for the purpose of providing the required services or for historical or statistical or legal purposes and such retention shall be for a period required to fulfill such purposes and / or as required under applicable law.
8. Transfer / Sharing of Information
We respect your privacy and hereby declare that we do not transfer and / or disclose your and/or your family members and/or your dependents' Personal Information and/or Sensitive Personal Data or Information except as under:
- To law enforcement agencies in connection with an investigation having the interest of general public at large, after having been approved by the due process of law;
- To our associates and affiliates to help detect and prevent fraud, identity theft and other illegal activities, correlate related or multiple accounts to prevent abuse of our services; and to facilitate joint or co-branded services that you request where such services are provided by more than one corporate entity;
- To our full time employees and associates on a need to know basis for the purpose of enabling the Company to provide the necessary services to you;
- With our empaneled healthcare providers on a 'need to know' basis for the purpose of enabling the Company to provide the necessary services to you;
- We shall also share such information with our associates or affiliates should the Company decide to undergo restructuring in anyway or is acquired by any other entity and ensure that in such an event the other entity continues to follow this policy strictly;
- With your employer or its authorized representatives, if applicable, and on receipt of a formal request from your employer and upon receipt of necessary approval(s).
9. Advertisements and links to third-party websites
Our Platform may contain certain advertisements and links to third-party websites. We would like to clarify that we do not control or guarantee the accuracy, safety and integrity of the Personal Information and/or Sensitive Personal Data or Information you provide, if you choose to, share your information with these advertisers and third-party websites. It is, therefore, advised that you go through their terms and conditions and privacy policy before providing any Personal Information and/or Sensitive Personal Data or Information about yourself and/or your family members and/or your dependents on these websites.
10. Safety Precautions
We have stringent, strong, security measures undertaken to ensure against the loss, misuse or alteration of Personal Information and/or Sensitive Personal Data or Information about you and/or your family members and/or your dependents with us. We shall take all necessary precautions to safeguard your information and protect it from any unauthorized use. We have SSL Certificate issued by trusted certification authority and other safety measures in place to guard your information with us against any theft or unlawful usage or modification thereof. You are advised, however, that internet technology is not 100% safe and you should exercise discretion on using the same. The Information Security Management System of the Company conforms to the ISO 27001:2013 standard.
11. Consent
By using our Platform and providing your and/or your family members and/or your dependents' Personal Information and/or Sensitive Personal Data or Information, you hereby consent to the collection, storage, disclosure, transfer, processing and usage of your and/or your family members and/or your dependents' Personal Information and/or Sensitive Personal Data or Information by us as per the terms of this Privacy Policy. You hereby confirm to the Company that you have taken necessary consent from your family members and/or your dependents for submission of their Personal Information and/or Sensitive Personal Data or Information with us.
By using this Application, You, understand, agree and acknowledge that by using this Application (“Service”) You voluntarily give Your full irrevocable consent to JLMUSH to collect, use, store Your sensitive personal information. You also consent to receive Service & marketing/promotional related telephonic calls, SMSs and/or emails from us and other Users. Such communications shall be sent to You on the telephone number and/or email id provided by You for the use of this Application which are subject to our Privacy Policy. Such communication by Us is for purposes that inter alia include but not limited to clarification calls, marketing calls and promotional calls by Us and our our affiliates, Service Providers, medical practitioners etc.
In the event you use the Application to book appointments with any of our affiliates, Service Providers, medical practitioners, You authorise Us and/or our affiliates, Service Providers, medical practitioners to send to You the booking confirmation, cancellation, payment confirmation, refund status, schedule change or any such other information relevant for the transaction, via SMS, Chat, or by voice call on the contact number provided by You at the time of making the appointment. This includes contacting you through information received from other parties. This consent for such further communication includes not limited to clarification calls, marketing and promotional calls for the purpose of providing, processing and administering the Services. You understand that Your personal information may be used for the purpose of contacting You pertaining to Your usage of the Services and further Service improvement purposes.
Right to opt out: The Company respects your privacy considerations and hence provides an option to you, to not provide the Personal Information and/or Sensitive Personal Data or Information sought to be collected. Further, you can also withdraw your consent which was earlier given to the Company, and the same must be communicated to the Company in writing. However, we inform you that on your electing to opt out (as envisaged in this section) or on withdrawal of your consent, the Company may not be in a position to provide you necessary services / benefits for which the Personal Information and/or Sensitive Personal Data or Information was sought to be collected.
You can stop all collection of information by the mobile application easily by uninstalling the mobile application from your device. You may use the standard uninstall processes as may be available as part of your mobile device or via the mobile application.
Further, you will have the option to not provide your consent, or withdraw any consent given earlier, provided that the decision to not provide consent / withdrawal of the consent is communicated to us at grievance@jlmush.in.

13. Governing rules and law
If you choose to visit our Platform, your visit/use and any dispute over privacy is subject to this Privacy Policy and the Platform's terms of use. In addition to the foregoing, any disputes arising under this Privacy Policy shall be governed by the laws of India.
This Privacy Policy is compliant with the provisions of the Information Technology Act, 2000 and Rules made thereunder including any modifications or amendments made thereto. The Company may make necessary changes to this Privacy Policy consequent upon any changes or modification in the law. 1. WHY THIS PRIVACY POLICY?
This Privacy Policy is published in compliance with, inter alia:
- Section 43A of the Information Technology Act, 2000;

2. COLLECTION OF PERSONAL INFORMATION
Generally some of the Services require us to know who you are so that we can best meet your needs. When you access the Services, or through any interaction with us via emails, telephone calls or other correspondence, we may ask you to voluntarily provide us with certain information that personally identifies you or could be used to personally identify you. You hereby consent to the collection of such information by JLMUSH . Without prejudice to the generality of the above, information collected by us from you may include (but is not limited to) the following:
- contact data (such as your email address and phone number);
- demographic data (such as your gender, your date of birth and your pin code);
- data regarding your usage of the services and history of the appointments made by or with you through the use of Services;
- insurance data (such as your insurance carrier and insurance plan);
- other information that you voluntarily choose to provide to us (such as information shared by you with us through emails or letters).
The information collected from you by JLMUSH may constitute ‘personal information’ or ‘sensitive personal data or information’ under the SPI Rules.
“Personal Information” is defined under the SPI Rules to mean any information that relates to a natural person, which, either directly or indirectly, in combination with other information available or likely to be available to a body corporate, is capable of identifying such person.
The SPI Rules further define “Sensitive Personal Data or Information” of a person to mean personal information about that person relating to: - passwords;
- financial information such as bank accounts, credit and debit card details or other payment instrument details;
- physical, physiological and mental health condition;
- sexual orientation;
- medical records and history;
- biometric information;
- information received by body corporate under lawful contract or otherwise;
- visitor details as provided at the time of registration or thereafter; and
- call data records.
JLMUSH will be free to use, collect and disclose information that is freely available in the public domain without your consent.
3. PRIVACY STATEMENTS
3.1 ALL USERS NOTE:
This section applies to all users.
3.1.1 Accordingly, a condition of each User’s use of and access to the Services is their acceptance of the Terms of Use, which also involves acceptance of the terms of this Privacy Policy. Any User that does not agree with any provisions of the same has the option to discontinue the Services provided by JLMUSH immediately.
3.1.2 An indicative list of information that JLMUSH may require you to provide to enable your use of the Services is provided in the Schedule annexed to this Privacy Policy.
3.1.3 All the information provided to JLMUSH by a User, including Personal Information or any Sensitive Personal Data or Information, is voluntary. You understand that JLMUSH may use certain information of yours, which has been designated as Personal Information or ‘Sensitive Personal Data or Information’ under the SPI Rules, (a) for the purpose of providing you the Services, (b) for commercial purposes and in an aggregated or non-personally identifiable form for research, statistical analysis and business intelligence purposes, (c) for sale or transfer of such research, statistical or intelligence data in an aggregated or non- personally identifiable form to third parties and affiliates (d) for communication purpose so as to provide You a better way of booking appointments and for obtaining feedback in relation to the Practitioners and their practice, (e) debugging customer support related issues.. (f) for the purpose of contacting you to complete any transaction if you do not complete a transaction after having provided us with your contact information in the course of completing such steps that are designed for completion of the transaction. JLMUSH also reserves the right to use information provided by or about the End-User for the following purposes:
- Publishing such information on the Website.
- Contacting End-Users for offering new products or services.
- Contacting End-Users for taking product and Service feedback.
- Analysing software usage patterns for improving product design and utility.
- Analysing anonymised practice information for commercial use.
- Processing payment instructions including those through independent third party service providers such as payment gateways, banking and financial institutions, pre-paid instrument and wallet providers for processing of payment transaction or deferral of payment facilities.
If you have voluntarily provided your Personal Information to JLMUSH for any of the purposes stated above, you hereby consent to such collection and use of such information by JLMUSH . However, JLMUSH shall not contact You on Your telephone number(s) for any purpose including those mentioned in this sub-section 4.1(iii), if such telephone number is registered with the Do Not Call registry (“DNC Registry”) under the PDPA without your express, clear and un-ambiguous written consent.
3.1.4 Collection, use and disclosure of information which has been designated as Personal Information or Sensitive Personal Data or Information’ under the SPI Rules requires your express consent. By affirming your assent to this Privacy Policy, you provide your consent to such use, collection and disclosure as required under applicable law.
3.1.5 JLMUSH does not control or endorse the content, messages or information found in any Services and, therefore, JLMUSH specifically disclaims any liability with regard to the Services and any actions resulting from your participation in any Services, and you agree that you waive any claims against JLMUSH relating to same, and to the extent such waiver may be ineffective, you agree to release any claims against JLMUSH relating to the same.
3.1.6 You are responsible for maintaining the accuracy of the information you submit to us, such as your contact information provided as part of account registration. If your personal information changes, you may correct, delete inaccuracies, or amend information by making the change on our member information page or by contacting us through privacy@JLMUSH.com. We will make good faith efforts to make requested changes in our then active databases as soon as reasonably practicable. If you provide any information that is untrue, inaccurate, out of date or incomplete (or becomes untrue, inaccurate, out of date or incomplete), or JLMUSH has reasonable grounds to suspect that the information provided by you is untrue, inaccurate, out of date or incomplete, JLMUSH may, at its sole discretion, discontinue the provision of the Services to you. There may be circumstances where JLMUSH will not correct, delete or update your Personal Data, including (a) where the Personal Data is opinion data that is kept solely for evaluative purpose; and (b) the Personal Data is in documents related to a prosecution if all proceedings relating to the prosecution have not been completed.
3.1.7 If you wish to cancel your account or request that we no longer use your information to provide you Services, contact us through support@JLMUSH.com. We will retain your information for as long as your account with the Services is active and as needed to provide you the Services. We shall not retain such information for longer than is required for the purposes for which the information may lawfully be used or is otherwise required under any other law for the time being in force. After a period of time, your data may be anonymized and aggregated, and then may be held by us as long as necessary for us to provide our Services effectively, but our use of the anonymized data will be solely for analytic purposes. Please note that your withdrawal of consent, or cancellation of account may result in JLMUSH being unable to provide you with its Services or to terminate any existing relationship JLMUSH may have with you.
3.1.8 If you wish to opt-out of receiving non-essential communications such as promotional and marketing- related information regarding the Services, please send us an email at support@JLMUSH.com.
3.1.9 JLMUSH may require the User to pay with a credit card, wire transfer, debit card or cheque for Services for which subscription amount(s) is/are payable. JLMUSH will collect such User’s credit card number and/or other financial institution information such as bank account numbers and will use that information for the billing and payment processes, including but not limited to the use and disclosure of such credit card number and information to third parties as necessary to complete such billing operation. Verification of credit information, however, is accomplished solely by the User through the authentication process. User’s credit-card/debit card details are transacted upon secure sites of approved payment gateways which are digitally under encryption, thereby providing the highest possible degree of care as per current technology. However, JLMUSH provides you an option not to save your payment details. User is advised, however, that internet technology is not full proof safe and User should exercise discretion on using the same.
3.1.10 Due to the communications standards on the Internet, when a User or the End-User or anyone who visits the Website, JLMUSH automatically receives the URL of the site from which anyone visits. JLMUSH also receives the Internet Protocol (IP) address of each User’s computer (or the proxy server a User used to access the World Wide Web), User’s computer operating system and type of web browser the User is using, email patterns, as well as the name of User’s ISP. This information is used to analyse overall trends to help JLMUSH improve its Service. The linkage between User’s IP address and User’s personally identifiable information is not shared with or disclosed to third parties. Notwithstanding the above, JLMUSH may share and/or disclose some of the aggregate findings (not the specific data) in anonymized form (i.e., non- personally identifiable) with advertisers, sponsors, investors, strategic partners, and others in order to help grow its business.
3.1.11 The Website uses temporary cookies to store certain (that is not sensitive personal data or information) that is used by JLMUSH and its service providers for the technical administration of the Website, research and development, and for User administration. In the course of serving advertisements or optimizing services to its Users, JLMUSH may allow authorized third parties to place or recognize a unique cookie on the User’s browser. The cookies however, do not store any Personal Information of the User. You may adjust your internet browser to disable cookies. If cookies are disabled you may still use the Website, but the Website may be limited in the use of some of the features.
3.1.12 A User may have limited access to the Website without creating an account on the Website. Unregistered Users can make appointments with the doctors by providing their name and phone number. In order to have access to all the features and benefits on our Website, a User must first create an account on our Website. To create an account, a User is required to provide the following information, which such User recognizes and expressly acknowledges is Personal Information allowing others, including JLMUSH , to identify the User: name, User ID, email address, country, ZIP/postal code, age, phone number, password chosen by the User and valid financial account information. Other information requested on the registration page, including the ability to receive promotional offers from JLMUSH , is optional. JLMUSH may, in future, include other optional requests for information from the User to help JLMUSH to customize the Website to deliver personalized information to the User.
3.1.13 This Privacy Policy applies to Services that are owned and operated by JLMUSH . JLMUSH does not exercise control over the sites displayed as search results or links from within its Services. These other sites may place their own cookies or other files on the Users’ computer, collect data or solicit personal information from the Users, for which JLMUSH is not responsible or liable. 1. End-Users using the Website by registering for an account on the Website or ‘JLMUSH ’ mobile application:
You can create an account by giving us information regarding your [name, mobile number, email address], and such other information as requested on the End-User registration page(2)(16p). This is to enable us to provide you with the facility to use the account to book your appointments and store other health related information.
Against every Practitioner listed in JLMUSH .com, you may see a ‘show number’ option. When you choose this option, you choose to call the number through a free telephony service provided by JLMUSH , and the records of such calls are recorded and stored in JLMUSH ’s servers. Such call will have an IVR message stating the purpose of recording your calls and your consent to such recordings which are dealt with as per the Privacy Policy. If you choose not to consent to recording of such call, JLMUSH hereby reserves the right to not provide you the Services for which such Personal Information is sought. Such records are dealt with only in accordance with this Privacy Policy.
2. End-Users using the Website without registering for an account on the Website or ‘JLMUSH ’ mobile application (i.e., ‘Guest’ End-User):
You can use the Website without registering for an account, but to book an appointment, you may be asked certain information (including your [mobile number], and such other information as requested when you choose to use the Services without registration) to confirm the appointment.
Against every Practitioner listed in JLMUSH .com, you may see a ‘show number’ option. 3. Practitioner availing of the free listing service on the Website or ‘JLMUSH ’ mobile application by registering for an account:
As a Practitioner, you may be required to provide us with information regarding your [name, mobile number, email address], and such other information as requested on the Practitioner registration page(3)(17p) to create an account. JLMUSH may send email and/or SMS confirmations or other communications to End-Users in connection with their bookings, appointments or other interactions with you, if such interactions have been facilitated by JLMUSH.
4. Practitioner availing of the free listing service on the Website or ‘JLMUSH ’ mobile application without registering for an account:
As a Practitioner, you may avail of the listing service without registering for an account by providing information regarding your [name, mobile number, email address], and such other information as requested by any of JLMUSH ’s employees or agents who contact you in person or by telephone. In such event, JLMUSH will maintain this information if and until you choose to register for an account, for which JLMUSH may contact you from time to time. JLMUSH will, after such information is collected from you, send you a confirmation email confirming the information provided and the fact that you will be listed on the Website. In the event you do not wish to be so listed on the Website, please inform JLMUSH immediately at support@JLMUSH.com
5. Practitioners using the ‘PLUSE’ and/or ‘PLUSE PRO’ products:
You will be required to create an account and may be required to provide JLMUSH with information regarding your [name, mobile number, email address, digital signature], and such other information as requested by JLMUSH on the PLUSE and/or PLUSE PRO Practitioner registration page, in order to complete your registration. Practitioner agrees to the use of the digital signature in the prescription and clinical notes as the regulatory requirements. JLMUSH will not access the said digital signature for any other purpose under any circumstance. Upon registration, JLMUSH will access non-personally identifiable information of your patients from your patient records. You agree to make your patients fully aware of such access.
JLMUSH reserves the right to extend and withdraw ‘ABS’ (also known as Instant) functionality to you at its sole discretion, based on the number of End-User appointments being honoured by you. The extension or withdrawal of such facility shall be intimated to you by JLMUSH .
You have an option under these products to switch on ‘End-User Feedback’. This will mean that you are giving one or more patients’ contact details to JLMUSH ’s feedback system. End-Users may choose to send feedback anonymously too, in which case you agree that you have no objection to such anonymous feedback. The feedback system will then send an SMS and email to the patient(s) asking for feedback which may then be published on the Website. You agree to make your patients fully aware of the possibility of their receiving such feedback queries.
6. Practitioners using the ‘JLMUSH RUN’ product:
You will be required to create an account and may be required to provide JLMUSH with information regarding your [name, mobile number, email address], and such other information as requested by JLMUSH on the ‘JLMUSH RUN’ Practitioner registration page, in order to complete your registration.
7. End-Users and Practitioners using the Consult platform.
You may be required to create an account and may be required to provide JLMUSH with information such as your name, mobile number, email address, and such other information as requested by JLMUSH on the JLMUSH consult registration page in order to complete your registration.
